The difference between eb2 and eb3 is the priority date (someone calls
it cut-off date). The current priority date, eb2: 1/1/1998,
eb3: 2/15/1997. That means, if you had applied with eb3, if your
lc receipt date was later than 2/15/1997, you can not file i-485 which
is the final stage of gc application. Sounds horrible, isn't it?
However, the priority date changes dramaticly from date to date. For
example, last August, both eb2 and eb3 were current. That means, you
can file i-485 immediately after you get your i-140 approval. I guess
it is very possible that both eb2 and eb3 priority date will be current
again within a year. In that case, there is no any difference between
them.
If you hold a MS in either CS or EE and you are working on the same
area, it is very normal that your case will go through RIR, no matter
eb2 or eb3. Actually RIR is for the first step, lc application.
It is taking about 3 months for lc to be approved. If you can not apply
RIR, you need additional 6 months for some legal steps, such as job
posting.

: : RIR/non-RIR is a different issue from EB2/EB3.
: : you can file RIR/EB2.
: : however, I wonder whether RIR or not makes sense

: : that is, even with RIR you get LC pretty quick,

: : but of course, god knows what will happen later.
: : maybe they will set cut-off date to current again...

: : : EB2...RIR normally takes 9 months to get

the gc process for chinese has a long backlog.
last year it was current because some special
reasons, not normal, and I don't think they
will make it current again.

I've heard non-RIR takes 2-3 years. but, if
if you have to wait until your PD current,
no difference anyway... if cut-off date changes
to current in the future, then RIR would be
better, you can file I-485 sooner.

I don't think the cut-off date is computer generated. IMHO,
those dates don't make much sense except keeping ur finger
crossed.
No one knows which date they are really processing at the
moment, and
No one knows what will be the next. The total process is a
black-box
controlled by INS and state dept. Sometime there are just
too many people
waiting outside, so they open the door for a while to save
those whose
H-1 will be expired. There IS the backlog for Chinese, so it
can't be
really current until all previously pending cases be
cleared. I still
know many people who filed I485 in 1997 in California and
didn't get approved, while
some applicants in 98 already got the GC. They are trying to
do sth to
make it more sense, and we will see.
About the current cut-off dates, in Apr for EB2 was
07/01/97, now is 01/01/98,
only 1/2 year, not one year.

: The priority date is 100% computer generated. It is based on how many
: i-485 cases are being adjusted. If the number is very high, like in
: this March (since lots of i-485 cases were filed after last August),
: the computer program thinks, "OK, we need to slow down the number of
: cases filed against i-485". That is why right now we can see a long
: back log date.
:
: One or two years ago, lots of guys (like me) had the same feeling as you
: have right now, that the date was moving so slowly that we even had
: no hope. However, it is always changing! I guess that based on less
: and less i-485 cases filed, the date will move very fast towards
: "current". You must have seen in the past two months, it moved about
: one year.
